By accessing or using Pulse (the “Service”), operated by Shades of Web Pvt. Ltd. (“we”, “us”, or “our”), you agree to be bound by these Terms of Service (“Terms”). If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

If you do not agree to these Terms, please do not use the Service. We reserve the right to update these Terms at any time. Continued use of the Service after updates constitutes your acceptance of the revised Terms.

Pulse is a collaboration platform designed to help engineering and product teams stay aligned through daily status updates, AI-powered insights, and team management tools. The Service includes web applications, APIs, integrations, and related features.

We may update, expand, or discontinue features of the Service at any time. We will make reasonable efforts to notify users when changes are material.

To access most features of the Service you must create an account. You agree to:

• Provide accurate, current, and complete information.
• Keep your account credentials secure and confidential.
• Notify us immediately at security@usepulse.ai if you suspect unauthorised access.
• Not share your account with others or create accounts on behalf of others without permission.

You are responsible for all activity that occurs under your account. We may suspend or terminate accounts that violate these Terms.

You agree not to use the Service to:

• Violate any applicable local, national, or international law or regulation.
• Upload, transmit, or distribute content that is harmful, threatening, abusive, defamatory, or otherwise objectionable.
• Attempt to gain unauthorised access to the Service, other accounts, or any related systems or networks.
• Interfere with or disrupt the integrity or performance of the Service.
• Reverse engineer, decompile, or disassemble any portion of the Service.
• Use the Service for competitive intelligence or benchmarking without our written consent.

All content, features, and functionality of the Service — including software, text, graphics, logos, and their compilation — are the exclusive property of Shades of Web Pvt. Ltd. and are protected by applicable intellectual property laws.

You retain ownership of content you submit to the Service (“User Content”). By submitting User Content you grant us a worldwide, non-exclusive, royalty-free licence to use, reproduce, process, and display that content solely to provide and improve the Service.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices around data collection, use, and disclosure.

Certain features require a paid subscription. By subscribing you agree to pay the applicable fees described on our pricing page. All fees are exclusive of applicable taxes unless stated otherwise.

Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. Refunds are issued at our sole discretion except where required by law.

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

To the maximum extent permitted by applicable law, Shades of Web Pvt. Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if we have been advised of the possibility of such damages.

Our total cumulative liability to you shall not exceed the amount paid by you to us in the twelve (12) months preceding the claim.

We may suspend or terminate your access to the Service at any time for any reason, including if we believe you have violated these Terms. You may terminate your account by contacting us at support@usepulse.ai.

Upon termination, provisions that by their nature should survive will survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Pune, Maharashtra, India.
